These terms govern use of The Dailys Wear website and purchases from our US clothing store. By using the site, creating an account, or placing an order, you agree to these terms and the policies linked here. You must be at least the age of majority where you live or use the store with the involvement and permission of a parent or legal guardian.
Provide accurate and current account, contact, payment, and delivery information. You are responsible for activity under your account and for protecting your sign-in credentials. You may not misuse the site, interfere with security, scrape or copy the store at scale, introduce malicious code, attempt unauthorized access, impersonate another person, or use the site for unlawful, fraudulent, or abusive purposes.
We work to describe and photograph garments accurately, including material, color, size, fit, and care information. Screen settings, lighting, dye lots, garment-wash processes, and manufacturing tolerances can cause reasonable variation. Size guides are general guidance and do not guarantee the same fit on every body or across every style. Follow the care label sewn into the garment; damage caused by improper washing, drying, alteration, or use is not a product defect.
Prices are shown in US dollars unless stated otherwise. Applicable tax and shipping are displayed at checkout. Product availability, prices, and promotions may change before an order is accepted. Promotional codes are subject to the terms presented with the offer, have no cash value, cannot be applied retroactively, and may not be combined unless expressly allowed. We may correct errors and cancel an affected order, with notice and a refund of any amount charged.
Submitting an order is an offer to purchase. An automated confirmation acknowledges receipt but does not guarantee acceptance. We may reject, limit, or cancel an order for unavailable inventory, pricing or description errors, suspected fraud, payment failure, resale activity, or delivery restrictions. The sales contract is accepted when we confirm shipment or otherwise expressly accept the order. If we cancel after payment, we will refund the canceled amount to the original payment method.
You authorize us and the selected payment provider to charge the total shown at checkout. Payment services may be supplied by Stripe, PayPal, Square, or Authorize.Net and may be governed by additional provider terms. We do not guarantee that every payment method will always be available. You remain responsible for valid charges, taxes, and fees disclosed before purchase.
Our Shipping Policy and Refund Policy form part of these terms. They explain processing estimates, delayed-order options, return eligibility, return postage, nonreturnable clothing, exchanges, and refund timing. Nothing in these terms limits a non-waivable consumer right or remedy available under applicable law.
The site and its original text, graphics, product photography, branding, layout, and software are owned by or licensed to The Dailys Wear and are protected by applicable intellectual-property laws. You may use the site for personal shopping only. No license is granted to reproduce, modify, distribute, sell, or commercially exploit store content without prior written permission. Third-party names and marks belong to their respective owners.
The store relies on third parties for payments, hosting, shipping, and other functions and may link to websites we do not control. Their services, availability, and privacy practices are governed by their own terms. We are not responsible for independent third-party content or conduct, but this provision does not remove responsibility that the law places on us for your order.
To the fullest extent permitted by law, the website is provided on an 'as available' basis without warranties concerning uninterrupted access or error-free operation. Garments remain subject to any express product warranty and to consumer protections that cannot be disclaimed. We do not exclude warranties, guarantees, or remedies that applicable law requires.
To the fullest extent permitted by law, The Dailys Wear will not be liable for indirect, incidental, special, exemplary, or consequential loss arising from site use or a purchase. Our aggregate liability for a claim relating to an order will not exceed the amount paid for the affected order. These limits do not apply to fraud, willful misconduct, personal injury caused by negligence, or any liability or consumer remedy that cannot legally be limited.
These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, while preserving any mandatory protections of the place where you live. Before filing a claim, please contact support@thedailyswear.com so we can try to resolve the issue. Unless applicable law requires otherwise, disputes may be brought in the state or federal courts located in New York County, New York.
We may update these terms prospectively by posting a revised version and effective date. Terms in effect when an order is accepted continue to govern that order. If a provision is unenforceable, the remaining provisions continue to apply. These terms and the incorporated policies are the agreement concerning the store and do not create rights for third parties.
